TERMS AND CONDITIONS

AirConditioner.com is GenieAC.com: All transactions are handled through Genie Air Conditioning & Heating Inc. AirConditioner.com is simply a second internet store for GenieAC.com. Airconditioner.com and Genieac.com is represented by Genie Air Conditioning & Heating Inc.

ORDERS: Orders received are subject to delays in filling due in whole or in part to any labor, materials, transportation or utility shortage or to any cause beyond our control. Deliveries are curbside only, unless otherwise specified. Extra charges may apply if otherwise.

TAXES: Any Federal, State or Municipal Tax imposed will be added to our prices unless otherwise specified.

MANUFACTURERS: The manufacturers we represent reserve the right to change specifications as conditions warrant.

CLAIM - SHORTAGES: All goods are shipped at buyer's risk. Our responsibility ceases upon delivery of goods in good order to the carrier. All goods should be examined carefully by the buyer before the transportation receipt is signed. If material is received in bad condition, the buyer should Reject Shipment Completely. Shortage claims will not be considered unless made in writing within (2) days of receipt of shipment. We will be glad to assist you in obtaining prompt adjustment on any damage Rejected or shortage claims.

RECEIVING INSTRUCTIONS: Do not sign for delivery until it has been inspected for shortages or checked for damages. Do know how many cartons are being signed for. Do keep your copy of freight delivery ticket in the event you find ''concealed damage'' after the driver has left your location.

NON-WARRANTY BY GENIE AIR CONDITIONING HEATING INC.: Genie Air Conditioning & Heating Inc. makes no Warranties, expressed or implied, including any warranties of merchantability or fitness. The only labor warranty which will apply to the material sold by Genie Air Conditioning & Heating Inc. is the warranty made by the manufacturer. Genie's representatives are without authority to alter or change the manufacturer's warranty terms.

ORDER CHANGES OR CANCELLATIONS: Order changes or cancellations must be made by telephone when speaking to a company representative. Cancellations or changes requested through e-mail or human click messages are not official and will not be honored. Please call and speak to a company representative for cancellations or order changes. We will not be responsible if the cancellation or order change was not received before it was shipped.

ERRORS: We reserve the right to correct clerical errors in quotations, orders, acknowledgements, invoices or other documents.

LABOR WARRANTY: The only labor warranty which will apply to the material sold by Genie Air Conditioning & Heating Inc. is the warranty made by the manufacturer. Genie's representatives are without authority to alter or change the manufacturer's warranty terms. We will not be responsible for loss or damage caused by fire, theft, or any other causes beyond our control.

CHANGE OF ADDRESS: Please notify us promptly of any change of address to avoid misdirected shipments and consequent delays. Additional charges may apply for re-routing or re-delivery fees.

RETURN POLICY: No goods will be accepted for return except by special permission, and if so, returns will be subject to a deduction of no less than 25% (see Reasons for Return Charges). All transportation charges, including freight and cartage will be paid by the customer Material mad eon special order or non-stocking items are not subject to return. Defective material under manufacturer's warranty, or material which has been replaced, must be prepaid and properly tagged and identified within (7) days.

DAMAGED MERCHANDISE: Any merchandise which has concealed or evident damage must be reported to Genie Air Conditioning & Heating, Inc. within (2) days of receipt. Notification must be done within (2) days in order for Genie Air Conditioning & Heating Inc. to file a claim with the corresponding shipping company, NO EXCEPTIONS. Package(s) must be kept intact, meaning the box(es) and all packing material must be retained for inspection. Any visible damage including dents, tears, holes, etc. MUST NOT BE ACCEPTED. You must call Genie Air Conditioning & Heating Inc. and let them know that you refused the merchandise. Failure to follow the above instructions will forfeit your right to file a claim. If merchandise is not operating according to specifications you might have a defective product which would be covered under the manufacturer's warranty. Each manufacturer has its own policies and procedures that must be followed precisely; therefore, the manufacturer must be contacted for further instructions. NOTE: only defective merchandise will go through the manufacturer. Damaged units should never be accepted upon delivery.

DEFECTIVE MERCHANDISE: If merchandise is not operating according to specifications you might have a defective product, which would be covered under the manufacturer's warranty. Each manufacturer has its own policies and procedures that must be followed precisely, therefore the manufacturer must be contacted for further instructions. NOTE: distinction must be made between damaged and defective merchandise in order to handle the matter properly and timely. Contact Genie Air Conditioning & Heating Inc. with any questions regarding this matter.

TERMS: Terms on open accounts do not apply. At (30) days each invoice will receive a 2% per month (24 APR) service charge. At (45) days accounts are placed on C.O.D. until current. When current, the account will be made as to the terms. If legal action becomes necessary to collect amounts due, reasonable attorney's fees and court cost will be added to the balance. If any account is not established all orders are pre-paid.
